NEW RULING FOR OBTAINING FLORIDA DRIVERS LICENSES 

In November, the Florida Department of Highway Safety and Motor Vehicles expanded the list of documents immigrants are able to use to obtain licenses.  Individuals may now use receipt notices from various applications for status.  This includes family-based petitions and employment-based petitions.  The change is a step forward for immigrant-eligibility for license in Florida.

Sandra C. Lambert, Director of the Division of Driver Licenses has issued the following bulletin  relative to October 1, 2002, Section 322.051, F.S., amended the identification requirements for non-immigrants. To ensure good customer service while maintaining the integrity of our licensing program, the following documents are acceptable as proof of legal presence to issue a license or identification card, not to exceed two calendar years for a driver license and four calendar years for an ID card.

1.            A current INS document indicating relief or pending processing. These documents may include an INS I-589 or I-539 form, a receipt for an application, a pending INS court case notice, or an INS printout stating the name of the customer and acceptance of an application (a cash register receipt or INS printout without the applicant's name is not acceptable).

2.               A notice from the Immigration Board of Appeals, an Immigration Judge, or the INS Inspection Unit with a court date for an appeal of denial (a letter or notice from INS stating an application has been denied is not acceptable).

3.               A receipt for an Employment Authorization Extension dated within the last six months. An Approval of Labor Certification form is not acceptable unless presented with an INS application for extension or adjustment of status.

If the customer does not present acceptable documents, he/she will be asked  to bring in all documentation received from INS. For additional information, please refer to the list of acceptable documents on the Division of Driver Licenses Intranet.

May have suffix-a, b, c, etc.
Must be within 2 years of date issued to be accepted.

Persons eligible for adjustment of status to that of LPR under the Life Act (Section 245i), must also submit their I-797 as evidence of applying for adjustment of status. In such cases only, a copy of a form I-130 or I-140 may also be accepted. All eligible beneficiaries identified in those forms can also be processed for driver licenses/ID cards as applicable although only the petitioner's name and the principal beneficiary is identified on the I-797

Order of Supervision

(OOS)

Issued to people who are ordered deported but are stateless so they cannot be deported. This order grants the person proof of legal presence.
